Resolving family disputes – new law

You must try to sort out your parenting disputes by using family dispute resolution before you file an application with the Family  Court or Federal Magistrates Court, unless an exemption applies to your situation.  

From 1 July 2008 you will also need to try family dispute resolution even if you just want to change your parenting orders. 

Exceptions

You may not have to use dispute resolution if an exemption applies to your situation. Exemptions include family violence or child abuse or if the matter is urgent.
